What this visa is

If your visa was refused or cancelled, you may have a right of review at the Administrative Review Tribunal (ART, formerly the AAT). Review rights depend on the decision. Under Migration Act s347, the general filing period is 28 days after notification, or 14 days if you are in immigration detention on the day you are notified. Certain character-review applications have a separate 9-day statutory period. The ART has no general power to extend these migration-review time limits.

Where applications go wrong

ART matters can involve strict jurisdictional deadlines, evidentiary strategy and a choice between review, re-application or another pathway. A registered migration agent can read the actual decision and review-rights notice, confirm the deadline and help prepare the case. Judicial review is a separate court process and may require legal advice.
