Transcript

If a subclass 482 visa was refused, check the ART deadline first. It's 28 days after notification, not the old 21-day rule.

Section 347 of the Migration Act sets the general period at 28 days after notification. If the applicant is in immigration detention on the day they're notified, it's 14 days.

It isn't an onshore-versus-offshore test, and the Tribunal has no power to extend it. Section 347 switches that power off, so the date in your notice is strict.

Who can seek review depends on where the applicant was when applying. From inside Australia, the applicant can seek review in some cases. From outside, only the sponsor or nominator can.

The 28 days run from legal notification, not the day the letter was opened. A posted document within Australia is taken as received 7 working days after its date, and 21 days after its date if sent overseas.

Review or a fresh application depends on why the 482 was refused, whether a new one can validly be lodged from your position, your visa status, and whether the evidence problem can be fixed.

From 1 July 2026 the ART fee for most migration reviews is $3,727, and half is refunded if the review succeeds. Character decisions under section 501 are a separate track with a 9-day deadline.

A refusal isn't the same as losing a sponsor. If you already hold a 482 and the job ends, condition 8607 allows up to 180 consecutive days, with a 365-day total across the visa. The old 60-day rule is obsolete.

If you want a registered agent to read the notice, Migratio's own data from September 2026 covers 686 quotes from 57 agents. The median initial consultation fee is $220, with the middle half between $150 and $275.
