Transcript

If your Australian student visa was refused, the first question is whether you can ask the Tribunal to review it at all. And which deadline applies.

Start with the refusal letter. It names the criteria you failed, the evidence the decision-maker looked at, your review rights, and any bar that applies, such as section 48.

Under the Migration Act, ART review of a student visa refusal is generally open only if you applied while in Australia, and you're physically in Australia when you apply for review.

Where review is open, the deadline is 28 days after you're notified, or 14 days if you're in immigration detention that day. A character decision under section 501 has only 9 days.

Genuine Student replaced the old Genuine Temporary Entrant test on 23 March 2024. It's answered as online questions in the application, each with a 150-word limit.

Points that often need a clear explanation in the answers: a course that doesn't connect to past study or work, a move to a lower qualification, or several changes of course or provider.

Money is the other common problem. As published by Home Affairs in September 2026, living costs are 29,710 dollars for the student, 10,394 for a partner and 4,449 for each child.

Then the cost comparison. The ART fee is $3,727, with half refunded if the review succeeds. A new application costs the visa application charge: 2,500 dollars for higher education, 2,050 for ELICOS or non-award study.

If you're in Australia, section 48 can limit a new application after a refusal. Subclass 500 isn't one of the visa classes listed in regulation 2.12 for that rule, and Home Affairs says to apply from outside Australia unless an exemption applies.

Reapplications go wrong in familiar ways: resubmitting the same case, leaving the prior refusal off the form, which can lead to a refusal under public interest criterion 4020, and rushing.

If you want a registered agent to read the refusal, Migratio's own data from September 2026 covers 686 quotes from 57 agents. The median initial consultation fee is $220, with the middle half between $150 and $275.
