On a visitor visa while your partner visa is processing? Everything comes down to one condition: does your subclass 600 carry condition 8503?
Three conditions to check on your grant letter. Condition 8101 means no work. Condition 8201 caps study or training at 3 months — it isn't a work condition. Condition 8503 means no further stay: no new visa while you remain in Australia.
If your visa doesn't carry condition 8503, you can apply for the partner visa, subclass 820, onshore before your visitor visa expires. A Bridging Visa A is granted straight away and activates the moment the visitor visa expires.
Travel is the trap. A Bridging Visa A alone doesn't let you leave and come back — if you depart on it without a Bridging Visa B, it's cancelled.
If condition 8503 does apply, you have three paths: ask for a waiver, leave and apply for the offshore partner visa, subclass 309, or — in rare cases — a protection visa.
A waiver isn't automatic. Home Affairs looks for compelling and compassionate circumstances that developed since the visa was granted — not a relationship that already existed when you arrived.
Leave before the visitor visa expires. Apply for the offshore partner visa, subclass 309, from outside Australia — it's decided outside Australia too. Then, if your passport is one of 34 eligible, an Electronic Travel Authority, subclass 601, lets you fly back while it's processed.
Work rights follow the same logic. No work on the visitor visa under condition 8101. Once the Bridging Visa A linked to the partner visa activates, work rights usually apply.
Let your visitor visa lapse with nothing lodged, and you become an unlawful non-citizen the next day. Leave Australia unlawfully, and a 3-year exclusion generally applies to your next visa application — unless you leave within 28 days of the visa ending.
The most common mistake: assuming condition 8201 is about work. It isn't — it only limits study. The condition that actually blocks you is 8503, and it's worth checking before you make any plan.
